Polk County Clerk of Superior Court

North Carolina does not split trial-court records between a district clerk and county clerk. Polk County court files are handled through the Clerk of Superior Court, a Judicial Branch office located at the Polk County Courthouse in Columbus. The clerk is the records custodian for local court files and also performs judicial functions in probate matters. Under G.S. 7A-109, clerks maintain court records, files, dockets, and indexes as prescribed by the Director of the Administrative Office of the Courts, and those records are open to public inspection during regular office hours unless a law prohibits access.

Polk County Clerk Record Duties

The Polk County Clerk of Superior Court handles the court file side of the local justice system. The office is tied to criminal cases, civil actions, estates, special proceedings, judgments, liens, divorce judgments, traffic and infraction matters, payments accepted by the clerk, and copy requests. Public self-service terminals can be used for criminal case information, and civil, special proceeding, and estates case information can also be accessed through public terminals when public. Paper files are accessed in the county where the case is located.

The clerk is not the Register of Deeds, Sheriff, NCDMV, or NC Department of Adult Correction. Marriage licenses, birth and death records, deeds, plats, assumed names, and powers of attorney route to the Polk County Register of Deeds. Jail custody, arrest search, incident search, and law-enforcement process route to the Sheriff. Driver history and license consequences route to NCDMV. State prison, probation, and parole records route to NC Department of Adult Correction.

Request Polk County Certified Copies

Certified copies are court copies issued with official certification for uses that require more than an online case view. Examples include divorce judgments, estate orders, judgment records, and other court documents that must be presented to another office or legal process. The NC court records help page says staff can provide copies for a fee, but ordinary copy requests should be directed to the clerk rather than to a statewide public records form when the user needs a case file document.

1. Search NC eCourts or a public terminal to identify the case number, party names, and document type.
2. Confirm that the file is a Polk County case and that the requested document is open to public access.
3. Call or visit the Polk County Clerk of Superior Court to ask how the office wants the request submitted.
4. Provide the case number, party names, document name, copy type, and mailing or pickup instructions.
5. Pay the required clerk fees and keep the receipt or payment reference for follow-up.

Polk County Clerk Request Fields

The research did not locate a Polk-specific downloadable court copy request form with a full field list. A practical request should still include enough identifiers for the clerk to find the record without creating a new compiled report. The Judicial Branch request page notes that state agencies and employees are not required to create or compile a public record that does not exist, which makes a precise request more useful than a broad search demand.

Polk County Clerk Fees

The research file documents several fees and payment rules tied to clerk or closely related record access. It does not provide a full statewide civil filing schedule for every case type, so the page should not invent missing amounts. Traffic and court payments have specific Polk County rules: mail payments must be money order or certified check, not cash or personal check; in-person payments may be cash, credit or debit card with processing fees, money order, or certified check; online payments use credit or debit cards with processing fees when the case is eligible.

Polk County Probate and Divorce

The Clerk of Superior Court is the probate office for Polk County. The NC Judicial Branch estates page explains that the elected Clerk of Superior Court in each county acts as probate judge, and assistant clerks hold many estate hearings. Estate matters may include wills, applications for letters, personal representatives, inventories, creditor notices, accountings, and estate closing records. If the validity of a will is challenged in a caveat proceeding, the case goes before a Superior Court judge.

Divorce judgments also route through the clerk because absolute divorce is a court case. Marriage licenses and marriage certificates do not. The Register of Deeds handles marriage records and licenses, while NC Vital Records may issue divorce certificates from 1958 forward. When a user needs the pleadings, judgment, custody order, support order, or case documentation, the Clerk of Superior Court is the correct office for the court record.

Common Polk County Clerk Forms
